If any person or group forcefully or through intimidation enters someone else’s land and takes possession of it while claiming it as their own, it is considered a case of forcible land grabbing.

Applicable Laws

Under the prevailing laws of Bangladesh, forcibly grabbing land is both a criminal and a civil offense.

  • Penal Code Section 441 – Criminal Trespass: Entering someone’s land without permission is considered a criminal offense.

  • Penal Code Section 506 – Criminal Intimidation: If land is grabbed through threats or intimidation, a criminal case can be filed against the accused.


Initial Steps to Take

If you become a victim of land grabbing, follow these steps

  1. File a General Diary (GD) or FIR at the police station.

  2. Mention details of the land, the time of occupation, and the names of the accused.

  3. Seek help from local public representatives if needed.

  4. Try to resolve the issue through arbitration via the chairman, member, or councilor.

  5. Submit a written complaint to the Upazila Nirbahi Officer (UNO) or Deputy Commissioner (DC).

  6. The land office may be instructed to investigate the matter.


Civil Court Procedure

If administrative remedies do not work, you can file a case in a civil court. Steps include

  • File a lawsuit regarding ownership.

  • Seek a Temporary Injunction so the land grabber cannot make any construction or changes on the land.

  • Submit original documents such as land deeds, tax receipts, and evidence of possession to the court.

If you delay reporting land grabbing, the problem may become more complicated. Without timely legal steps, the grabber may avoid criminal liability and might even claim ownership of the land.
